A Dallas college student who was severely beaten on South Padre Island during a spring break party has filed a lawsuit against the resort and sponsor.

Derek Madrigal, 21, was beaten by a group of at least 10 men, sustaining a collapsed lung and nine stab wounds.

Madrigal's suit charges Coca-Cola and the Isla Grand Beach Resort with negligence and says that the beach party they sponsored had a lack of security.

Nearly 10,000 people attended the spring break party on March 17.

According to the lawsuit, Madrigal noticed a group of men harassing a young woman and politely tried to intervene on her behalf. The suit states that members of the Texas Mexican Mafia, a San Antonio-based prison gang, pummeled Madrigal, stabbing him, punching him, kicking him and slamming him with beverage coolers.

Several onlookers videotaped the attack with cellphone cameras.

Madrigal, who nearly died of his injuries, said he continues to physically and mentally suffer as a result of the attack.

In the lawsuit, Madrigal charges that the party's sponsors failed to inform attendees that prison gangs would be attending, failed to check attendees for weapons and failed to adequately train or staff security at the event, which prolonged the attack and jeopardized the lives of others.

The lawsuit does not specify an amount in damages.

Madrigal said he does not know when or if the case would be heard in court.
